How fathers can prepare as they seek custody of their children

California fathers who want to pursue custody of their children might face some biases from the court as they go through the process. Though many biases have disappeared over time, their root comes from the traditional roles parents played in the past.

In the past, it was generally accepted that mothers stayed home to nurture their children and take care of the family and that fathers were the providers who worked outside the home. As times changed, however, and many couples became two-income families or roles reversed with the mother becoming the main provider and the father becoming the stay-at-home parents, some biases remained. These include the belief that mothers are more nurturing and capable of taking care of children, that mothers being the primary caretaker is in the best interest of the child and that fathers do not have enough time to take care of their children.

However, fathers can prepare themselves to counter these biases when seeking to raise their children by continuing with open, intact communication with the mother, actively working to develop a parenting plan and by presenting proof of their relationship with the child. In the end, the court's decision must be made based on the best interest of the children, and this will include evaluating each parent's ability to financially support the child, each parent's relationship with the child, the child's particular needs and other aspects that might vary from court to court.

The process of seeking child custody is delicate and emotional. However, parents might consult with a family law lawyer who might provide guidance and support. The lawyer might explain to the parent what the court will be looking for as proof, help the parent prepare for court appearances and assist the parent as they negotiate a parenting plan that works for the entire family.
