Why prenuptial agreements are beneficial for some couples

The last thing that most couples in California want to talk about after getting engaged is a prenuptial agreement. However, it is a necessary conversation. It can help the couple to set expectations as to the kind of financial partnership they intend to share once they get married.

A prenuptial agreement is a contract that is legally binding. It typically addresses how assets and liabilities would be divided if the couple were to divorce in the future. It can also outline the confidentiality of finances or other personal information, preventing a spouse from sharing information with the public, friends or family members. If a couple does not have a prenuptial agreement and they get divorced, a judge will usually decide how their assets will be distributed.

The earlier a couple can have a conversation about finances and draw up the prenuptial agreement, the better. It allows the couple to talk about how they will manage money and what each person is expecting. Even if the couple decides that a prenuptial agreement is not right for their circumstances, having these conversations and having a consultation with a family law attorney allows each individual to understand what the law would prescribe if the contract is not in place and they divorce.

One factor that courts consider when determining if a prenup is enforceable is when the contract was signed. If it was signed right before the wedding date, the argument could exist that the prenup was signed under duress. Couples who are interested in the benefits that could come from signing a prenup could speak with an attorney. The attorney could provide information about prenuptial agreements and a variety of divorce legal issues. They could offer assistance in the preparation of this document and help each party to protect their assets.
