Treat the other spouse with respect in a divorce

In a California divorce action, a court may have to decide issues such as property division and custody of the children. There are various factors that a court could consider in reaching its decisions. One of these could be the relationship between the spouses. Thus, a spouse who mistreats the other or tries to harm the other's reputation may suffer in the court's final decision.

An example of this could be a spouse who publically tries to ruin the other's personal or professional standing. The consequence of this is that the spouse's earning power can be reduced. As a result, a court may give the harmed spouse a greater share of the marital estate to compensate for the reduced earnings or damaged reputation.

Another consequence is that the custody picture may be impacted. A court will look at the best interests of the children as the deciding factor. If there is a poor relationship that is caused by one parent's mistreatment of the other, a judge will consider that in either awarding custody or setting the visitation schedule. Courts prefer when parents are able to work together, and if there is tension, the judge will look to see who is the cause of the problems.

Judges do not react favorably when one spouse harshly mistreats the other whether it is publically or privately. The last thing that a divorcing spouse wants to do is make a gross error in judgment simply because something feels good or they are settling a perceived score. Sometimes, better judgment is required to not harm self-interest when a matter is in front of a judge.
